§ 1 Operational field

1. This businessconditions are related to all businessrelations currently and in the future.
2. Clients in this businessrelation are natural persons who are interested in our service without any businesslike involvements.
   Contractor is a natural, a juridical person or a legal company who act businesslike or professional to provide a certain service.
   Client-Contractors might be private persons or contractors.
3. Additional businessconditions of the client- contractors are not valid in a contract except there exists a written agreement

§ 2 Costs and payment

1. Our offers are free till they are accepted.
2. Packaging and shipping are not included.
3. Expenses for businesstrips and boarding during the process of orders will be invoiced according to collected bills.

§ 3 Deliverance

1. Landgang organizes and provides several walks with different topics for business and private clients.
2. Landgang advices the clients in the choice of appropriate providers and reserves and controls these services for the clients.
3. Advertised services are in the exclusive responsibility of the proposed provider and will be invoiced seperately by this provider.

§ 4 Terms of the contract

With the booking of a walk, the client offers a contract to Landgang. The booking might be made in oral or written form by phone, fax or e-mail. With the acceptance of the written confirmation (sent by Landgang) the contract is valid. Landgang is entitled to confirm the contract within two weeks.

§ 5 Charge of fees

1. The fee for of the walks is bound to the contract in particular.
2. The fee for the advisory services will be invoiced by hourly fees.
3. Services of external providers will be invoiced by each particular provider for itself.

§ 6 Obligations of the client

The written confirmation by Landgang should be controlled after receiving it. Any corrections has to be notified immediatly.

§ 7 Limit of liability

1. In the case of carless violation of obligations, the liability of Landgang is limited to the foreseeable, contractlike and immediate average loss. This concerns also the carless violations of the employees or replacements of Landgang.
2. For business relations with contractors, the liability of Landgang is excluded in case of minor careless violations.
3. The limitation of liability above does not concern client.s claims for compensation and healthproblems or death caused by the services of Landgang.

§ 8 Terms of advisory services

If Landgang advices in the choice of other providers like hirer of locations, caterers or artists etc.the contract is bound to the businessconditions of the particular providers.

§ 9 Notice of Mistake

If problems arise in the fullfillment of obligation torwards the client of Landgang, the provider has to report this immediatly to Landgang.

§ 10 Withdraws

In the case a client withdraws a booking or if he misses the appointment Landgang is entiteld to charge following compensation. Withdrawal one week before the date of booking is 20 percent of the agreed charge, withdrawel three days before is 40 percent of the charge and withdrawel one day before or a missed appointment is the full charge. The client is obliged to inform Landgang immediatley (within 48 hours by phone) of a change of the booking.The client might prove that there is no severe loss for Landgang because of a withdrawal.

§ 11 Further conditions

1. Only the jurisdiction of Germany is valid.
2. Through possible invalidities of some conditions of the confirmation or the general business conditions the liability of the other conditions won't be altered. The invalid conditions will be replaced through conditions which are comparable to common law.
3. If the client is contractor, juridical person or a legal company only the place of jurisdiction for Landgang is concerned. Also if the client does not live in Germany or his remains are not clearified or if he does not run his business in Germany only the jurisdiction for Landgang is concerned.
4. Through possible invalidities of some conditions of the contract or the general business conditions the liability of the other conditions won't be altered. The invalid conditions will be replaced through conditions which are the best possible solutions for the economic prosperity within common law.
